Sheep to the Slaughter, Part I

by

Article I, Section 8, is titled “Powers of Congress”.  It is a sort of misnomer since what Section 8 actually does is explain the LIMITS of the powers that are given to Congress.  When the introduction says “The Congress shall have the power”

Clause 1:

The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defense and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States;

What the Founders are saying here, or more correctly, compromised on, is that the Federal Government will collect revenue through duties and impost, (which are another way of say import and export taxes), and Excises, which is taxes on Booze, roads and other such items that are done for the general good and the use of all Americans.  Notice that Income Tax is not included.  The reason is simple, there is no such thing, there is no way to have a fair individual income tax.  It was best said this way; “I predict future happiness for Americans if they can prevent the government from wasting the labors of the people under the pretense of taking care of them.”   Thomas Jefferson  At present the Congress is taking our money and using it to ensure that they get reelected by fooling you into believing that you need them to bring home money from other states.

Clause 2:
To borrow Money on the credit of the United States

That is pretty straight forward.  The problem with that is, if you are borrowing money to pay for things that are simply doing any of the following, placing our debt upon those who follow us, buying votes, giving the working efforts of some to those who do not work.  This spending more than we get is part of the reason we are in the shape we are in.  All this spending in order to tighten their hold on the people trying to impress upon people that the Government is the end all of what you need, provide the protection you want, and will give you everything you want.  But remember:  Government big enough to supply everything you need is big enough to take everything you have … The course of history shows that as a government grows, liberty decreases. Thomas Jefferson

Clause 3:

To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes;

There are two problems with this “power”, one it is not very clear and more importantly not being clear is “regulate commerce with…the several States.  This commerce clause has allowed the Federal Government to trespass in virtually every aspect of our life under the guise that every thing that ‘might” effect anything that might cross borders of the many States.  The more we “need” Government, the more the Government will try and provide it.  Beware of such things because; Experience hath shewn, that even under the best forms of government those entrusted with power have, in time, and by slow operations, perverted it into tyranny.
Thomas Jefferson
